Terms of Use

These Terms govern access to Stook. Stook provides agricultural decision support; it does not execute transactions or replace your independent business and professional judgment.

1. Acceptance and eligibility

By accessing or using Stook, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and able to enter a binding agreement. If you use Stook for a farm, company, cooperative, or other organization, you represent that you have authority to accept these Terms for that organization.

2. The service

Stook provides grain-marketing and farm-economics decision support using user inputs, deterministic rules, public or licensed market data, historical analysis, and, in limited features, constrained AI-generated explanations of validated information.

Features, data coverage, sources, and availability may change. Pilot, trial, and demo features may use fixtures, incomplete data, local or ephemeral storage, or experimental interfaces and may be modified or discontinued.

3. Decision support only

Stook is a decision-support tool, not a substitute for your own judgment or advice from qualified professionals. Stook is not your broker, commodity trading advisor, dealer, elevator, agent, fiduciary, crop-insurance agent, lender, lawyer, tax adviser, accountant, or agronomist.

Stook does not provide legal, tax, accounting, investment, derivatives, insurance, lending, or agronomic advice. References to tax deadlines, financing, discounts, storage, carry, basis, costs, or program terms are informational and may not apply to your facts.

You are responsible for checking quantities, production, coverage, costs, bids, basis, quality specifications, delivery periods, contract language, program eligibility, taxes, financing terms, and deadlines before acting. Verify every bid, deadline, and contract directly with the applicable elevator, vendor, lender, insurer, accountant, lawyer, or other professional.

4. No transaction, custody, or agency role

Stook does not buy or sell grain, execute or arrange contracts, direct trading accounts, accept orders, take title to grain, provide custody, hold customer funds, pool producer money or grain, guarantee payment or delivery, or become a party to an agreement between you and a third party.

Any transaction is entered directly between you and the applicable third party under terms you independently review and accept. Links, contact information, comparisons, or offer-preparation tools do not make Stook an agent or representative of either party.

5. Historical, hypothetical, and illustrative results

Backtests, simulations, historical comparisons, demo results, timing illustrations, and counterfactual benchmarks are hypothetical or illustrative. They do not represent an actual account or guarantee that a user would have achieved the result shown.

Historical and simulated results can be affected by hindsight, assumptions, data availability, omitted costs, bid selection, liquidity, quality discounts, delivery constraints, financing, taxes, storage, and other factors. Past or simulated performance does not guarantee future results.

Input-program values are timing illustrations unless supported by qualifying product, eligibility, invoice, payment, financing, and verification evidence. They must not be treated as realized savings.

6. Accounts and credentials

You are responsible for the security of your account and for activity conducted through it. Provide accurate information, use only accounts and farm records you are authorized to access, and notify us promptly if you suspect unauthorized use.

Google sign-in is provided through a third-party authentication service. Your use of Google services is also governed by Google’s terms and privacy practices.

7. Your information and permissions

You retain ownership of information you submit. You grant Stook a limited, non-exclusive license to host, process, reproduce, and display that information only as reasonably necessary to provide, secure, support, and improve the service and as described in the Privacy Policy.

You represent that you have the right to submit the information and that doing so does not violate law, confidentiality, contract, or another person’s rights. Do not submit information belonging to another farm or person without authorization.

8. Acceptable use

You may not misuse Stook or help another person do so.

  • Do not access another user’s account or records, bypass access controls, probe for vulnerabilities without written permission, or interfere with service operation.
  • Do not submit malware, unlawful content, false identity information, or data you lack authority to use.
  • Do not scrape, copy, resell, reverse engineer, or systematically extract the service or its data except as permitted by law or written authorization.
  • Do not use Stook to coordinate prices, allocate markets, manipulate bids, violate competition law, or conduct an unlawful transaction.

9. Third-party services and data

Stook may rely on or link to government, university, vendor, elevator, authentication, hosting, or AI services. We do not control third-party availability, accuracy, terms, security, or privacy practices. A source link or reference is not an endorsement or guarantee.

Market information may be delayed, stale, incomplete, estimated, aggregated, or unavailable. Source timestamps and caveats are part of the information you must review before acting.

10. Stook materials

Stook and its software, design, text, calculations, compilation, and branding are owned by or licensed to Stook and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the service for its intended purpose; they do not transfer ownership.

If you send product feedback, you permit us to use it without restriction or compensation, provided we do not publicly identify you without permission.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOOK IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND THAT THE SERVICE WILL BE ERROR-FREE OR MEET YOUR REQUIREMENTS.

We do not warrant any recommendation, market data, source, program term, calculation, expected price, savings amount, tax result, delivery outcome, or business result. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOOK AND ITS OPERATORS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, CROP VALUE, CONTRACT OPPORTUNITIES, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO STOOK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY ARISING FROM OR RELATED TO STOOK WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID STOOK DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 100 U.S. DOLLARS. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Stook and its operators from third-party claims and reasonable costs arising from your unlawful misuse of the service, your violation of these Terms, or information you submit without authorization. This obligation does not apply to the extent a claim results from Stook’s own conduct for which indemnification cannot lawfully be required.

14. Suspension and termination

You may stop using Stook at any time. We may suspend or terminate access when reasonably necessary to protect the service or others, address misuse or legal obligations, or discontinue a feature. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, and dispute provisions.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where applicable law requires otherwise. Before filing a claim, you and Stook agree to make a good-faith effort to resolve the issue informally by written notice. Nothing in these Terms prevents either party from seeking relief that cannot lawfully be waived or limited.

16. Changes to the service or Terms

We may modify the service and these Terms. We will update the date above and provide additional notice when required. Material changes apply prospectively from their effective date. Continued use after a change becomes effective constitutes acceptance where permitted by law.
